MOHRE decides whether your contracts, work permits and salary transfers are valid. Which employers it covers, what it requires, and where free zones differ.

What Is MOHRE? Its Role in Contracts, Permits and Payroll Compliance

MOHRE is the UAE Ministry of Human Resources and Emiratisation. It regulates private sector employment on the mainland: it issues work permits, holds the approved employment contract templates, monitors salary payment through the Wage Protection System, inspects and classifies establishments, and fines employers who breach the labour law.

What MOHRE is

MOHRE is the federal regulator for private sector employment in the UAE, acting under Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations and its executive regulations, Cabinet Resolution No. 1 of 2022.

For an HR or payroll lead it is the system of record that decides whether a person may legally work for you, on what contract, and whether last month's salary counts as paid. Three records have to agree: the work permit, the registered employment contract, and the wage transferred through the Wage Protection System. When they disagree, transactions stop.

Who falls under MOHRE, and who does not

Article 3(1) applies the Decree-Law "to all Establishments, Employers and Workers in the Private Sector in the State". Article 3(2) excludes federal and local government employees, the armed forces, police and security, and domestic workers. The distinction that catches multi-entity groups is between mainland, ordinary free zones and financial free zones.

DIFC Employment Law No. 2 of 2019 applies at Article 4 to "any person having a place of business in the DIFC ... who employs one (1) or more individuals". ADGM describes itself as a financial free zone exempt from the UAE Federal Labour Law. Neither has a MOHRE contract template or a MOHRE work permit. Ordinary free zones are not carved out of the federal labour law and do sit inside the Wage Protection System. Jafza states that all businesses registered with it must comply with the UAE WPS, and has done since 2012.

What MOHRE requires

  1. Establishment registration. A MOHRE electronic signature card, issued after the ministry inspects the premises and verifies compliance, plus a firm card from the relevant General Directorate of Residency and Foreigners Affairs.
  2. A job offer, then a matching contract. Article 10(1) of Cabinet Resolution 1 of 2022 sets the minimum contents: occupation, joining date, place of work, hours, rest days, probation, term and the agreed wage with benefits and allowances. Article 10(4) requires "contract templates approved in the Ministry's system".
  3. A work permit. Article 6(1) of the Decree-Law: work may not be practised in the State except after obtaining a permit from the Ministry. Article 6(1) of Cabinet Resolution 1 of 2022 lists twelve types, among them recruitment from outside the State, transfer, temporary, mission, part-time, juvenile, student employment, GCC citizens, golden residency holders and freelance.
  4. The residency chain. The permit is valid for 60 days, in which the employee completes medical testing, obtains an Emirates ID and has the labour card number issued before the residence permit is stamped.
  5. Wage payment through WPS. Article 16 of Cabinet Resolution 1 of 2022 requires establishments registered with the Ministry to pay wages on their due dates "through the Wage Protection System or any other system approved by the Ministry".
  6. Emiratisation. Establishments with 50 or more employees carry a skilled-jobs target of 2 per cent annually. Those with 20 to 49 employees in 14 specified sectors had to employ one UAE citizen from 2024 and two from 2025.
  7. Unemployment insurance. All private sector employees must join the Involuntary Loss of Employment scheme. It exempts investors who own the establishment, domestic workers, temporary contract holders, workers under 18 and Emirati retirees.

What happens if you do not comply

Article 59 of the Decree-Law sets AED 20,000 to AED 100,000 for supplying incorrect information when recruiting from abroad and for obstructing officials. Article 60 sets AED 100,000 to AED 1,000,000 for employing a worker without a permit, for bringing in a worker and leaving them unemployed, and for fictitious appointments, with Article 62 allowing the fine to multiply per worker up to AED 10,000,000. Article 63 is residual, AED 5,000 to AED 1,000,000.

Non-financial consequences bite faster. MOHRE suspends issuance of new work permits to an establishment that has not paid wages through the WPS, which stops recruitment, transfers and renewals across the whole entity, not just for the employee involved. Classification is the second lever: Article 2(1) of Cabinet Resolution 1 of 2022 sets the criteria as "economic activity, volume of manpower, manpower's cultural and demographic diversity and compliance with legal regulations", and classification drives the fees a company pays for ministry transactions.   • WPS (Wage Protection System) – the electronic salary transfer system MOHRE-registered establishments must pay through, operated with the Central Bank of the UAE.
  • Establishment card – the entity-level immigration registration allowing a company to sponsor residence visas, distinct from the MOHRE signature card.
  • Labour card – the MOHRE record confirming an individual is legally employed by a named establishment, issued inside the 60-day permit window.
  • Nafis – the federal Emiratisation programme run by the Emirati Human Resources Competitiveness Council, supporting UAE nationals entering private sector jobs.
  • Tawteen / Emiratisation – the obligation to employ UAE nationals at prescribed rates, set by headcount and sector.
  • ILOE – compulsory involuntary loss of employment insurance paying 60 per cent of the subscription salary for up to three months.

Where a system helps

The recurring failure in UAE payroll is three records drifting apart: the salary in the MOHRE contract, the salary in the payroll master, and the amount in the file sent to the bank. FAQ

Is MOHRE the same as the Ministry of Labour? Yes, renamed in 2016. Bank-published WPS specifications still refer to MOL and to MOL-issued person and employer identifiers. Those are the identifiers MOHRE issues today.

Do free zone companies register employees with MOHRE? Ordinary free zone companies register with their free zone authority, which issues the permit, but stay inside the federal labour law and inside the WPS. DIFC and ADGM companies do neither.

Does MOHRE set a minimum wage? No statutory minimum exists. The government portal states only that wages must meet employees' basic needs. What MOHRE enforces is that the wage paid matches the wage in the registered contract.

Can a MOHRE contract be changed mid-term? Any change to the contractual wage or terms must be registered in the ministry's system, not only in payroll. Raise a salary internally without amending the registered contract and the two records disagree, which surfaces in WPS monitoring rather than at the next audit.
